1. Introduction and Role of the Agency
1.1 The Agency as an Intermediary: Safari Artistry acts as an intermediary (agent) for third-party service providers ("Suppliers") including, but not limited to, airlines, hotels, guesthouses, car rental companies, tour operators, cruise lines, and other service providers. 1.2 No Direct Provision of Services: The Agency does not own, operate, manage, or control these Suppliers. Our role is solely to facilitate bookings and arrangements on your behalf with these Suppliers. 1.3 Supplier Terms and Conditions: All bookings are subject to the specific terms and conditions, as well as the rules and regulations, of the respective Suppliers. By confirming a booking, you agree to be bound by the Supplier's terms and conditions, which may include clauses on liability, cancellation, refunds, and changes. Copies of Supplier terms and conditions are available upon request. 1.4 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
2. Bookings, Quotes, and Payments
2.1 Quotations: All quotations provided by the Agency are estimates only, based on availability at the time of quoting, and are subject to change without prior notice. Prices are not guaranteed until full payment has been received and the booking has been confirmed by the Supplier(s). 2.2 Validity: Quotations are valid for the period specified in the quote, after which they may expire or be subject to reconfirmation. 2.3 Deposit and Full Payment: a. A non-refundable deposit, as specified in your quotation or invoice, is required to confirm a booking. No booking is confirmed until the deposit has been received by the Agency. b. Full payment must be received by the Agency on or before the due date specified in your invoice. Failure to make full payment by the due date may result in the automatic cancellation of your booking by the Supplier(s) without notice, and cancellation charges (as per Clause 3) will apply. 2.4 Price Fluctuations: Prices are subject to change due to factors beyond the Agency's control, including but not limited to: a. Currency fluctuations and exchange rate variations. b. Increases in airfares, fuel surcharges, government taxes (e.g., airport taxes, VAT), or levies imposed by authorities or Suppliers. c. Changes in Supplier pricing. Any such increases may be passed on to the client, even after a deposit has been paid, up until the point of full payment and final ticketing/confirmation. 2.5 Payment Methods: Payments can be made via Electronic Funds Transfer (EFT) or credit card, as specified by the Agency. Credit card payments may incur a service fee, which will be advised at the time of payment. 2.6 Accuracy of Information: It is your sole responsibility to ensure that all names, dates, and other personal information provided to the Agency for booking purposes are accurate and correspond exactly with the details in your passport or official identification document. Any discrepancies may result in additional charges, re-issuance fees, or cancellation of services, for which the Agency accepts no liability.
3. Cancellations and Amendments
3.1 Client-Initiated Cancellations: a. All cancellations must be submitted to the Agency in writing. b. Cancellation charges will apply to all cancelled bookings. These charges will include: i. A non-refundable administration fee charged by the Agency, as advised at the time of cancellation. ii. Any cancellation fees levied by the Suppliers (airlines, hotels, etc.), which can be up to 100% of the total booking value, depending on the Supplier's terms and the proximity of the cancellation to the travel date. c. Refunds for cancelled services are subject to the Supplier's refund policies and processing times. The Agency will endeavor to facilitate such refunds but is not responsible for delays or non-payment by Suppliers. 3.2 Agency/Supplier Initiated Changes or Cancellations: a. In the unlikely event that a booking is cancelled or significantly altered by a Supplier due to unforeseen circumstances (e.g., operational reasons, overbooking, natural disasters, political instability), the Agency will inform you as soon as reasonably possible. b. The Agency acts solely as an agent and accepts no liability for any loss, damage, or inconvenience caused by such changes or cancellations by Suppliers. Any recourse or compensation will be subject to the Supplier's terms and conditions. c. Where possible, the Agency will offer alternative arrangements or a refund of monies received from the Supplier, less any non-refundable deposits or administration fees. 3.3 Amendments: Any changes or amendments to confirmed bookings (e.g., date changes, name changes) may incur an amendment fee charged by the Agency, in addition to any fees levied by the Suppliers.
4. Travel Documents and Requirements
4.1 Client Responsibility: It is your sole responsibility to ensure you possess all necessary and valid travel documents, including but not limited to: a. Passports: Valid for at least six (6) months beyond your intended return date, with sufficient blank pages for visas and entry/exit stamps. b. Visas: Required for all countries you will enter, transit through, or exit, as per their respective immigration regulations. c. Health Certificates/Vaccinations: Any required health certificates or proof of vaccinations (e.g., Yellow Fever). d. International Driver's Permits: If applicable for car rentals. 4.2 Minors Travelling: Special regulations apply to minors travelling, particularly in and out of South Africa. It is your responsibility to obtain the most current information regarding these requirements and ensure compliance. 4.3 Travel Advisories: You are responsible for researching and understanding any travel advisories, health warnings, or entry restrictions (e.g., related to epidemics, pandemics, or political situations) issued by relevant government bodies (e.g., Department of International Relations and Cooperation - DIRCO). Your decision to travel is made with full knowledge of any associated risks. 4.4 Document Delivery: Travel documents (e-tickets, hotel vouchers, etc.) will be delivered electronically or made available for collection, as agreed. It is your responsibility to check all details carefully upon receipt and immediately notify the Agency of any discrepancies.
5. Travel Insurance
5.1 Mandatory Recommendation: The Agency strongly recommends that all clients take out comprehensive travel insurance at the time of booking confirmation. 5.2 Coverage: Comprehensive travel insurance should cover, but not be limited to, cancellation or curtailment due to any reason, medical emergencies, repatriation, personal accident, personal liability, loss of or damage to baggage, and other unforeseen events. 5.3 No Liability for Lack of Insurance: The Agency shall not be held liable for any loss, damage, injury, illness, or expense whatsoever arising from your failure to obtain adequate travel insurance coverage. Any expenses incurred due to insufficient insurance will be your sole responsibility. 5.4 Credit Card Insurance: Be aware that travel insurance provided by credit card companies may offer limited coverage. It is your responsibility to verify the extent of such coverage and supplement it if necessary.
6. Liability and Disclaimers
6.1 Agency as Agent: The Agency acts solely as an agent for Suppliers and accordingly accepts no liability whatsoever for any loss, damage, injury, accident, delay, illness, harm, or death which may be sustained or suffered by you or any member of your travelling party arising from or in connection with: a. Any act or omission, default, or failure on the part of any Supplier to fulfill their obligations. b. Any failure on your part to comply with these Terms and Conditions or the terms and conditions of any Supplier. c. Any unforeseen circumstances or events of Force Majeure (including but not limited to natural disasters, war, civil unrest, political instability, riots, strikes, pandemics, epidemics, government regulations or advisories, or any other event beyond the Agency's control). d. Your failure to obtain adequate travel insurance. e. Your failure to obtain or carry valid passports, visas, health certificates, or other necessary travel documents. f. Any loss or damage to property or baggage. 6.2 Inherent Risks: You acknowledge that travel, especially international travel, may involve certain inherent risks. You voluntarily assume all such risks and understand that the Agency cannot guarantee your safety or protection against all hazards. 6.3 Limitation of Liability: Notwithstanding anything to the contrary contained herein, in no event shall the Agency's aggregate liability for any claims arising out of or in connection with these Terms and Conditions or the services provided, whether in contract, delict (including negligence), or otherwise, exceed the total amount paid by you to the Agency for the specific booking in question. The Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages. 6.4 Consumer Protection Act: Nothing in these Terms and Conditions is intended to contravene or limit any rights you may have as a consumer under the Consumer Protection Act, 68 of 2008, as amended ("CPA"). In the event of any conflict, the provisions of the CPA shall prevail.
7. Client Conduct
7.1 Responsible Behavior: You are expected to conduct yourself in a responsible manner, respecting local laws, customs, and the rights and property of others, including fellow travellers and locals. 7.2 Compliance with Supplier Rules: You must comply with the rules and regulations of all Suppliers (e.g., airline baggage allowances, hotel check-in/check-out times, tour operator instructions). Failure to do so may result in refusal of service, for which the Agency bears no responsibility. 7.3 Unacceptable Behavior: The Agency or any Supplier reserves the right to refuse service to any client whose behavior is deemed disruptive, offensive, illegal, or harmful to themselves or others.
8. Complaints Procedure
8.1 Reporting Issues: Should you experience any problems or dissatisfaction with the services provided by a Supplier during your travel, you must immediately bring it to the attention of the Supplier (e.g., hotel management, airline representative, tour guide) to allow them the opportunity to resolve the issue on the spot. 8.2 Formal Complaints: If the issue cannot be resolved at the time, you must submit a written complaint to the Agency within [e.g., 21] days of your return from travel, providing full details and supporting documentation. 8.3 Agency's Role in Complaints: The Agency will endeavor to assist in resolving the complaint with the Supplier but acts solely as an intermediary and cannot guarantee a specific outcome.
9. Privacy Policy (POPIA Compliance)
9.1 Collection of Personal Information: The Agency collects personal information (such as names, contact details, passport information, health details if relevant) necessary to process your bookings and provide travel services. 9.2 Purpose of Collection: This information is collected solely for the purpose of facilitating your travel arrangements, communicating with you, and complying with legal and regulatory requirements. 9.3 Sharing of Information: Your personal information will be shared with relevant Suppliers (e.g., airlines, hotels) and necessary third parties (e.g., payment processors) solely for the purpose of fulfilling your booking. The Agency will endeavor to ensure that these parties respect your privacy. 9.4 Client Rights: You have the right to access and correct your personal information held by the Agency, as per the Protection of Personal Information Act (POPIA), 4 of 2013.
